The University of International Business and Economics Holds the International Conference on the 60th Anniversary of the New York Convention and the UN Convention on International Settlement Agreements Resulting from Mediation

On November 3, 2018, the University of International Business and Economics (UIBE) held the International Conference on the 60th Anniversary of the New York Convention and the UN Convention on International Settlement Agreements Resulting from Mediation. The conference was hosted by the China Council for the Promotion of International Trade (CCPIT) and the United Nations Commission on International Trade Law (UNCITRAL), and was organized by UIBE, the Legal Affairs Department of CCPIT and the China Arbitration Law Research Association. Mr. Lu Pengqi, vice president of CCPIT, and Mr. Jiang Qingzhe, secretary of the Party Committee of UIBE, attended conference and delivered welcoming speeches. Ms. Anna Joubin-Bret, secretary-general of UNCITRAL, made a keynote speech.

More than 200 people from the academic and practice field attended the conference, including: Professor Zhang Yuejiao, former WTO Appellate Body Member, Ms. Gao Xiaoli, vice-president of Civil Adjudication Tribunal No.4 of the Supreme People’s Court of PRC, Mr. Li Jianning, secretary of the Commercial Legal Service Center of CCPIT, Mr. Li Hu, deputy secretary-general of the China International Economic and Trade Arbitration Commission (CIETAC), Ms. Xie Changqing, deputy secretary-general of the China Maritime Arbitration Commission (CMAC), Mr. Chen Jian, deputy secretary-general of the China Arbitration Law Research Association, Professor Shen Sibao of UIBE Law School, Professor Shi Jingxia, dean of UIBE Law School, Professor Xiao Yongping from the Institute of International Law of Wuhan University, Mr. Chen Fuyong, deputy secretary-general of the Beijing Arbitration Commission (BAC), representatives from the International Chamber of Commerce (ICC), Asia International Arbitration Center, Hong Kong International Arbitration Center, the Arbitration Institute of the Stockholm Chamber of Commerce, and other world-renowned arbitration institutions.

In the conference, Mr. Lu Pengqi, vice president of CCPIT, pointed out in his speech that the New York Convention has greatly promoted the unification of international commercial arbitration legislation and practice, and it is of great significance to the universal recognition and enforcement of legal and effective arbitral awards. In addition to arbitration, mediation, as a more flexible method of dispute resolution, has been increasingly valued by the parties worldwide with the advantages of high efficiency and low cost. CCPIT is willing to work with academics and practitioners of international dispute resolution to deeply understand and promote the New York Convention and UN Convention on International Settlement Agreements Resulting from Mediation to build a long-term legal exchange platform, promote diversified dispute resolution, explore the establishment of an international commercial dispute settlement mechanism, facilitate practical cooperation in various fields and contribute to the development of international rules.

Mr. Jiang Qingzhe, secretary of the Party Committee of UIBE, welcomed all to UIBE and stated that arbitration is an international way to settle international commercial disputes, and the New York Convention is the most important international convention in this field. Secretary Jiang hoped that the participants would facilitate ideas during the conference and contribute to the field of international commercial arbitration.

At the book-giving ceremony, Vice President Lu Pengqi presented the “Belt and Road” national legal research series edited by CCPIT to Secretary Jiang Qingzhe. Published by Xinhua News Agency, this series has presented laws of 27 out of 64 countries in the first batch.

Ms. Anna Joubin-Bret, secretary-general of UNCITRAL, first reviewed the history of drafting and signing the New York Convention in her keynote speech. She pointed out that the New York Convention is not only an important outcome of UNCITRAL, but also the cornerstone of cross-border enforcement of arbitral awards, and it has a forward-looking and guiding role in the resolution of future international trade disputes. Secondly, she highlighted the latest achievements of UNCITRAL in the field of mediation - the International Settlement Agreement. She said that the convention would be submitted to the UNCITRAL general assembly for consideration by the end of the year and expected to be open for signature in Singapore in August next year. Finally, she briefed the progress that UNCITRAL has made in the field of investment disputes and appreciated the idea of dispute prevention proposed by CCPIT.

The main purpose of this conference was to celebrate the 60th Anniversary of the New York Convention and the adoption of the draft of the UN Convention on International Settlement Agreements Resulting from Mediation. Four specialized seminars were held, namely “New Development of the Implementation of the New York Convention”, "China's Implementation of the New York Convention", "New York Convention, International Settlement Agreement and ‘Belt and Road’ Construction", and "New York Convention, International Settlement Agreement and investor-host country investment dispute settlement". The participating experts and scholars shared their research and practice experience in the relevant fields of the New York Convention and the International Settlement Agreement, and conducted deep discussion on the understanding, application and interpretation of specific provisions in international conventions, the recognition and enforcement of arbitral awards and mediation agreements, as well as the impact of relevant international conventions on international trade and investment.

At the closing ceremony, Mr. Liu Chao, vice-minister of the Legal Affairs Department of CCPIT expressed his gratitude to all the distinguished guests for their wonderful speeches. He believed that the New York Convention and the International Settlement Agreement, which will be ready for signing next year, will play an increasingly important role as countries pay more attention to and promote dispute settlement methods such as arbitration and mediation. Moreover, he stressed that dispute prevention should also indicate the direction of future efforts by the international community. To prevent and resolve disputes through consultation, negotiation, standard contract, due diligence and other means, is ex ante, efficient, economical and harmonious. Finally, he issued an initiative to the participants, hoping that everyone will work together to jointly prevent and resolve international commercial disputes, and continuously promote the development of international multilateral and bilateral trade and investment.
